QuantiaMD Participant Terms and Conditions

This is a legal agreement between you (“Participant”) and Quantia Communications, Inc. (“Quantia”) for participation in QuantiaMD. BY CLICKING “I AGREE”, YOU AGREE TO THESE TERMS AND CONDITIONS (“Agreement”).

Quantia builds and maintains a network of clinicians and provides content, tools, services and rewards in exchange for information which is used for valid business purposes such as marketing, market research, and education. By consenting to this Agreement, Participant agrees to be a member of Quantia’s community of clinicians.

In exchange for activities such as providing market research, engaging the online community, or submitting original content, the Participant will earn and accumulate rewards, expressed as “QPoints” which may be redeemed for medically relevant products and services as offered on our redemptions Web page.

The Participant acknowledges that their responses via the Quantia network, and any other information that the Participant shares with Quantia, may be provided to Quantia’s sponsors for market research and other valid purposes. Any information provided by the Participant will be subject to the privacy agreement Quantia has established with its sponsors.

Participant also acknowledges that Quantia may, from time to time, contact Participant via email with service related announcements of importance to members of QuantiaMD. Participant may opt out of these communications at any time by either choosing the opt out link that appears at the bottom of any such emails or by editing their profile page.

Both the Participant and Quantia have the right to terminate this Agreement for convenience at any time through written communication by either the Participant or Quantia to the other party.

Permitted Use:

The Participant agrees to observe all applicable laws while visiting this web site, (www.quantiamd.com the "Site"). The contents of the Site are owned by Quantia or its named content partners and are protected by all applicable international copyright treaties and the copyright laws of the United States. The Participant may not modify, copy, reproduce, republish, upload, post, transmit, transfer, or distribute in any way any of the contents of the Site. The Participant may not display the Site in frames, or any of the content via in-line links, without the express written permission of Quantia. The Participant may download content from the Site solely for personal, non-commercial use, provided the Participant keeps intact all copyright and other proprietary notices.

Third-party Sites:

The Site may contain links to other sites for the convenience of the Participant. These third-party sites may also request personal information from the Participant. These third-party sites are not covered by these Participant Terms and Conditions and Quantia is not responsible for the privacy practices or the content of such other web sites.

Trademarks:

QuantiaMD, and the QuantiaMD logo, are trademarks of Quantia. The Participant may not use any of the Marks for any purpose, including without limitation their use as metatags on other pages or web sites without the prior written permission of Quantia.

Changes:

Quantia reserves the right to change, modify, add or remove portions of this Agreement any time, but will indicate the date they were last updated. When the Participant visits or uses the Site, the Participant is accepting the current version of this Agreement as posted on the Site at that time.

Medical Disclaimers:

The informational content and user comments available on QuantiaMD are for informational and educational purposes only. The Participant is expected to use their own professional judgment when utilizing information found on QuantiaMD. The Participant accessing QuantiaMD assumes full responsibility for the use of the information and agrees that Quantia, its partners, associates, and any other providers of content are not responsible or liable for any claim, loss, or damage arising from the use of the information.

Patient Data & HIPAA Compliance:

Commenting, case consult features, article submissions and other features of QuantiaMD may enable the Participant to transmit, store, review or receive confidential patient information ("Patient Information"). It is the sole responsibility of the Participant to comply with State and Federal laws, as well as institutional and professional guidelines with respect to patient confidentiality. The Participant is, at all times during the term of this Agreement and thereafter, solely responsible for obtaining and maintaining all patient consents, if applicable, and all other legally necessary consents or permissions required or advisable to disclose, process, retrieve, transmit, and view Patient Information. QUANTIA CANNOT AND DOES NOT ASSUME ANY RESPONSIBILITY FOR THE USE OR MISUSE OF PATIENT INFORMATION OR OTHER INFORMATION TRANSMITTED, MONITORED, STORED OR RECEIVED BY THE PARTICIPANT WHILE USING THE SITE AND THE MATERIALS ON THE SITE. WE RESERVE THE RIGHT TO AMEND OR DELETE ANY MATERIAL (ALONG WITH THE RIGHT TO REVOKE ANY MEMBERSHIP OR RESTRICT ACCESS TO QUANTIAMD) THAT IN OUR SOLE DISCRETION VIOLATES THE ABOVE.

Privacy:

When the Participant registers, we ask that they provide Quantia with certain personal information. Quantia uses personal information to provide customized content and deliver content relative the personal interests of the Participant. Quantia does not sell the Participant’s personal information to third parties. All personal information provided to Quantia in conjunction with use of the Services by the Participant will be protected by Quantia and retained within Quantia except for limited cases as outlined in Quantia’s Privacy Statement.
